1. Acceptance of Terms

Welcome to Streak Up! We provide a premium mobile application (the "App") designed to help individuals committed to quitting alcohol track their sobriety journey and build lasting alcohol-free habits. These Terms of Service ("Terms") govern your use of our App and any related services provided by Oleksii Yehorov, operating as Streak Up ("we," "us," or "our").

By accessing or using our App, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the App.

2. Description of Service

Streak Up provides tools and resources to help individuals track and manage their alcohol sobriety journey. Our V1 services for alcohol cessation include:

• Reliable sobriety streak tracking (days, months, years, H:M:S).
• Tracking of money saved from not purchasing alcohol, based on user input.
• Guided daily journaling with mood and craving level logging.
• Progress statistics including sobriety overview, money saved details, mood/craving trends, and milestone achievements.
• Daily motivational insights.

3. Eligibility

You must be at least 18 years of age to use Streak Up. By using our App, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms. This App is not intended for individuals under the age of 18.

4. User Accounts

To use certain features of our service, you may need to create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activities that occur under your account

We reserve the right to disable any user account if we believe you have violated these Terms.

5. User Content (Journal Entries & Check-ins)

The App allows you to create and store journal entries, including text, mood ratings, and craving levels, as well as daily check-in data (collectively, "User Content"). This User Content is stored privately for your use within the App. You retain all ownership rights to your User Content.

By using the App, you grant Streak Up a limited, worldwide, non-exclusive, royalty-free license to use, store, reproduce, and process your User Content solely for the purposes of:

• (a) providing and operating the App's services for you (e.g., displaying your journal entries and stats); and
• (b) for internal purposes such as data analysis and service improvement, provided that such data is used in an aggregated and anonymized form that does not personally identify you.

We will handle your User Content in accordance with our Privacy Policy. You are solely responsible for the User Content you create and store.

6. Prohibited Conduct

You agree not to:

• Use the service for any illegal purpose or in violation of any laws
• Harass, abuse, or harm another person
• Impersonate or misrepresent your affiliation with any person or entity
• Interfere with or disrupt the service or servers connected to the service
• Attempt to gain unauthorized access to any part of the service
• Use the service to distribute unsolicited promotional content
• Use the service to collect user information without consent
• Post content that is offensive, harmful, or otherwise objectionable

7. Health Disclaimer

Streak Up is not a substitute for professional medical advice, diagnosis, or treatment. The content provided through our service is for informational purposes only.

8. Intellectual Property

Streak Up and its original content, features, and functionality are owned by Streak Up and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

9. Subscriptions and Payments

Streak Up is a subscription-based app.

• Free Trial: We offer a 7-day free trial for new users.
• Subscription Terms: After the trial, continued use of the App requires a paid subscription (weekly, monthly, or annually).
• Billing: Subscriptions are managed and billed through the Apple App Store or Google Play Store. All payments are processed by these platforms.
• Auto-Renewal: Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.
• Cancellations & Refunds: You can manage and cancel your subscriptions through your App Store or Google Play Store account settings. Refund policies are governed by the respective store's terms.

10. Limitation of Liability

To the maximum extent permitted by law, Streak Up and its affiliates, officers, employees, agents, partners and licensors will not be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the service
• Any conduct or content of any third party on the service
• Any content obtained from the service
• Unauthorized access, use or alteration of your transmissions or content

11. Termination

We may terminate or suspend your account and access to our services immediately, without prior notice or liability, for any reason, including, without limitation, if you breach these Terms of Service.

Upon termination, your right to use the service will immediately cease. If you wish to terminate your account, you may simply discontinue using the service or contact us to request account deletion.

12. Changes to Terms

We reserve the right to modify or replace these Terms at any time. We will provide notice of any material changes through the service or by other means. Your continued use of the service after any such changes constitutes your acceptance of the new Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, USA, without regard to its conflict of law provisions.
